Under the Fair Housing Act, landlords must provide reasonable accommodation for ESAs in most housing situations. They cannot charge pet fees or deposits for ESAs. However, they can deny if: (1) the property has 4 or fewer units and the owner lives there, (2) the animal poses a direct threat, or (3) the animal would cause undue financial burden. As of January 2021, ESAs no longer have automatic airline cabin access. The Department of Transportation changed the rules, and airlines are no longer required to accommodate ESAs in the cabin for free. Some airlines may allow ESAs to travel as pets (with a fee).
